Terms of Service

This is a placeholder Terms of Service included with CreemKit so your project ships with a legal page structure out of the box. Creem requires a Terms of Service before approving your store. Replace this content with your own terms before going live.

These Terms of Service ("Terms") govern your access to and use of CreemKit and any deployed instance of the template (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Definitions

• Service — the CreemKit template, its documentation, and any application deployed from it.
• Company — refers to CreemKit and its maintainers (also "we", "us", or "our").
• User — any individual or entity that accesses or uses the Service (also "you" or "your").
• Account — your registered profile used to access authenticated areas of the Service.
• Subscription — a recurring billing plan managed through Creem that grants access to paid features.
• Credits — a consumable balance within the Service that can be spent on specific actions or features.
• Content — any text, data, files, or materials you upload, submit, or transmit through the Service.

Account Registration

To access certain features, you must create an account using a valid email address or a supported OAuth provider (such as Google or GitHub) through Supabase Auth.

You agree to:

• Provide accurate and complete registration information
• Keep your login credentials secure and confidential
• Notify us immediately if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent.

Use of the Service

Permitted Use

You may use the Service for lawful purposes in accordance with these Terms. CreemKit is provided as a starter template — you are free to modify, deploy, and build upon it for your own projects.

Prohibited Conduct

You agree not to:

• Use the Service for any unlawful or fraudulent purpose
• Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service beyond what the open-source license permits
• Use the Service to distribute malware, spam, or other harmful content
• Resell, sublicense, or redistribute the Service as a competing template or starter kit without significant modification

Subscriptions and Payments

Billing

Paid features are billed on a recurring basis through Creem. By subscribing, you authorize Creem to charge your chosen payment method at the start of each billing cycle.

All prices are displayed in the currency specified at checkout and are inclusive or exclusive of taxes as indicated.

Free Trials

If a free trial is offered, you will not be charged until the trial period ends. You may cancel at any time before the trial expires to avoid being billed.

Cancellation

You may cancel your subscription at any time through the Service or via the Creem customer portal. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• You will not be charged for subsequent billing cycles
• Access to paid features will end when the current period expires

Refunds

Payments are generally non-refundable. If you believe you were charged in error, contact us within 14 days of the charge and we will review your request on a case-by-case basis.

Credits

Credits are a prepaid balance used to access specific features or actions within the Service.

• Credits are non-transferable and have no cash value
• Unused credits do not expire unless your account is terminated
• Refunds for purchased credits are handled on a case-by-case basis
• We reserve the right to modify credit pricing and consumption rates with reasonable notice

Intellectual Property

Our Rights

The Service, including its original source code, design, documentation, and branding, is owned by CreemKit and protected by applicable intellectual property laws. The open-source license governs your rights to use and modify the codebase.

Your Content

You retain ownership of any Content you submit through the Service. By submitting Content, you grant us a limited, non-exclusive license to store, process, and display it solely for the purpose of operating the Service.

You represent that you have the necessary rights to any Content you submit and that it does not violate the rights of any third party.

Third-Party Services

The Service integrates with third-party platforms including:

• Supabase — authentication, database, and storage
• Creem — payment processing and subscription management
• Vercel (or your chosen host) — deployment and hosting

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any defects will be corrected within a specific timeframe

Limitation of Liability

To the maximum extent permitted by applicable law, CreemKit and its maintainers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:

• Loss of revenue, data, or business opportunity
• Service interruptions or downtime
• Unauthorized access to your account or data
• Errors or omissions in any content

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless CreemKit and its maintainers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any Content you submit through the Service

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and associated data after a reasonable retention period
• Provisions that by their nature should survive termination (such as liability limitations and indemnification) will remain in effect

You may terminate your account at any time by contacting us or using the account deletion feature within the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved through good-faith negotiation first. If a resolution cannot be reached, disputes shall be submitted to the competent courts of the governing jurisdiction.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you via email or a prominent notice within the Service.

Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
